नई दिल्ली, 12 सितंबर 2025। सुप्रीम कोर्ट ने केंद्र सरकार के अनुरोध पर बड़ा फैसला सुनाया है। कोर्ट ने SEBI-सहारा रिफंड अकाउंट से 5,000 करोड़ रुपये की नई राशि जारी करने की अनुमति दी है, ताकि सहारा समूह की कोऑपरेटिव सोसाइटीज़ में निवेश करने वाले जमाकर्ताओं को उनका बकाया लौटाया जा सके।
यह आदेश जस्टिस सूर्यकांत और जस्टिस जॉयमाल्या बागची की पीठ ने सॉलिसिटर जनरल तुषार मेहता की दलीलें सुनने के बाद दिया। साथ ही कोर्ट ने निवेशकों तक राशि पहुंचाने की समयसीमा 31 दिसंबर 2026 तक बढ़ा दी।

SEBI की आपत्ति खारिज
सुनवाई के दौरान SEBI के वकील ने कोर्ट से सोमवार तक आदेश रोकने का निवेदन किया, लेकिन पीठ ने इसे अस्वीकार कर दिया। कोर्ट ने स्पष्ट किया कि यह आदेश किसी सहमति (consent) से पारित नहीं किया गया है।
मार्च 2023 का आदेश और नई पहल
मार्च 2023 में भी सुप्रीम कोर्ट ने 5,000 करोड़ रुपये जारी करने का आदेश दिया था। उस समय कोर्ट ने बताया था कि 24,979.67 करोड़ रुपये “Sahara-SEBI Refund Account” में बिना उपयोग पड़े हैं।
अब एक बार फिर 5,000 करोड़ रुपये जारी किए जाएंगे, जिन्हें Central Registrar of Cooperative Societies के माध्यम से वास्तविक जमाकर्ताओं तक पहुंचाया जाएगा। यह पूरी प्रक्रिया पूर्व सुप्रीम कोर्ट जज आर. सुभाष रेड्डी की निगरानी में होगी।
अब तक की रिफंड प्रक्रिया
- मार्च 2023 में जारी राशि का वितरण वेब पोर्टल के जरिए किया गया।
- अब तक 26,25,090 जमाकर्ताओं को 5,053.01 करोड़ रुपये लौटाए जा चुके हैं।
- 13,34,994 निवेशकों के दावे लंबित हैं, जिनकी कुल राशि लगभग 27,849.95 करोड़ रुपये है।
- अब तक कुल दावे 1,13,504.124 करोड़ रुपये (लगभग 5.43 करोड़ निवेशकों द्वारा) किए जा चुके हैं।
- अनुमान है कि दिसंबर 2026 तक करीब 32 लाख और निवेशक अपने दावे पेश कर सकते हैं।

New Delhi, 12 September 2025: The Supreme Court has delivered a major decision allowing the release of ₹5000 crore from the SEBI-Sahara Refund Account to repay depositors of Sahara Group of Cooperative Societies.
The order was passed by a bench of Justices Surya Kant and Joymalya Bagchi after hearing Solicitor General Tushar Mehta. The Court also extended the timeline for disbursal of amounts under the March 2023 order and today’s order until 31 December 2026.
SEBI Objection Overruled
During the hearing, a counsel representing SEBI requested the Court to hold the order until Monday. However, the bench rejected this request and clarified that the order is not a consent order.
March 2023 Order and Fresh Disbursal
In March 2023, the Supreme Court had also directed the release of ₹5000 crore, noting that ₹24,979.67 crore were lying unutilized in the “Sahara-SEBI Refund Account.”
Now, a fresh amount of ₹5000 crore will be transferred to the Central Registrar of Cooperative Societies, who will disburse the funds to legitimate depositors. The process will be supervised by former Supreme Court judge Justice R Subhash Reddy and follow the procedure outlined in the March 2023 order.
Disbursal Process So Far
The March 2023 disbursal was carried out via a web portal for genuine investors to file claims.
So far, 26,25,090 depositors have received refunds totaling ₹5,053.01 crore.
13,34,994 investors have pending claims, totaling approximately ₹27,849.95 crore.
Total claims filed so far amount to ₹1,13,504.124 crore (by around 5.43 crore investors).
It is estimated that about 32 lakh more investors may file claims by December 2026.
